      The present article discusses the case of Willem Van de Nesse, a parish priest, and archbishop Precipiano, his canonical superior. Precipiano had suspended Van de Nesse, however without following due canonical procedure. The Council of Brabant took jurisdiction of the case. It decided that Precipiano had violated Van de Nesses rights of peaceful possession because he had not respected the requirements of canonical procedure. The Council maintained Van de Nesse in the possession of his parish. This case serves as a starting point for a description of the evolution of the recursus ad principem in the Netherlands, and for a comparison with similar procedures in France (the appel comme d'abus) and in Spain (the recurso de fuerza).
