      The article offers a general background on informed consent law in the U.S. The legal maxim demanding informed consent prior to the performance of a medical process is well based in the common law. Under the negligence standard, the basic elements of any negligence claim are needed to found duty, liability and harm, however states vary on the standard to define physician negligence.
