      This article dealt with the limits of the job interview by the Picker from the perspective of the principles of intimacy and privacy. Considering that the practice currently adopted by the Human Resource administration, has been asking questions that confront the Constitution, as well as the Brazilian legislation on the subject, giving an opportunity to inquiries about the reasons for the employee to make Questions, whose answers cannot be taken into account for access to employment, under the penalty of discriminatory conduct.       O presente artigo tratou dos limites da entrevista de emprego pelo selecionador sob a perspectiva dos princípios da intimidade e da privacidade. Considerando que a prática atualmente adotada pela administração de recursos humanos, vem fazendo perguntas que afrontam a constituição, assim como a legislação brasileira sobre o tema, dando ensejo à questionamentos sobre os motivos que levam o empregado a fazer perguntas, cujas respostas não poderão ser levadas em consideração para acesso ao emprego, sob pena de estar havendo conduta discriminatória.
