    • Abstract:
      The right to identity is a compendium of physical and cultural characteristics that allow the personal assimilation of each individual within a social system. The objective of this research, within the first chapter, is to address in a general way the issue of gender identity in childhood and adolescence in relation to the active participation of the Ecuadorian State, in terms of the contribution to the recognition of trans children and adolescents. The core of the problem is the difficulty that this group of people have to adhere and participate dynamically in society. The right to identity will be studied from two perspectives: one static and the other dynamic. These concepts have existed prior to the conception of identity as a human right; therefore, it is pertinent to understand these bases that have given rise to deeper perspectives regarding the development of rights. In the second and third chapter, it will analyze the issue of conventionality control, understood as a theoretical and jurisprudential construct that guarantees the harmonization of the norms of domestic law and human rights, based on the constitutional provision of Art. 424, second paragraph, which states that the acts of domestic authority must be assessed on the basis of international law, which is expressed in treaties or conventions.       El Derecho a la identidad es un compendio de características físicas y culturales que permiten la asimilación personal de cada individuo dentro de un sistema social. La presente investigación, tiene como objetivo, Analizar la falta de reconocimiento legal de la identidad de género de niños, niñas y adolescentes trans en Ecuador. Pues el núcleo del problema, es la dificultad que este grupo de personas tienen para adherirse y participar dinámicamente en sociedad. El Derecho a la identidad se estudiará desde dos perspectivas: estática y dinámica. Estos conceptos han existido previamente a la concepción de la identidad como derecho humano, por tanto, es pertinente entender estas bases que han dado lugar a perspectivas más profundas en cuanto al desarrollo de derechos. En el segundo y tercer capítulo, se analizará el control de convencionalidad, entendido como un constructo teórico y jurisprudencial que garantiza la armonización de las normas del derecho interno y los Derechos Humanos, con base en la disposición constitucional del Art. 424, inciso segundo donde señala que se deben valorar los actos de autoridad interna en fundamento del Derecho Internacional, que se expresa en los tratados o convenciones.
